By creating a BlueSend account or sending email through the BlueSend API, you agree to these terms on behalf of yourself and any organization you represent.

2.The service (link to this section)

BlueSend provides tools to send transactional and marketing email from domains you control, including domain verification, templates, environments, API keys, suppression and audit logging. Features may change as the product evolves.

3.Your responsibilities (link to this section)

You are responsible for the content you send, for having a lawful basis and permission to email each recipient, and for complying with anti-spam laws (including CAN-SPAM, GDPR and CASL) and our Acceptable Use Policy.

You must keep your API keys secret and are responsible for activity under your account.

4.Acceptable use (link to this section)

Your use of BlueSend is subject to the Acceptable Use Policy. We may suspend sending that threatens deliverability, violates the AUP, or generates excessive bounces or complaints.

5.Fees (link to this section)

Paid plans are billed as described on the pricing page once pricing is finalized. Placeholder pricing is not an offer and is subject to change before launch.

6.Disclaimers & liability (link to this section)

The service is provided “as is” without warranties, and our liability is limited to the maximum extent permitted by law. Final disclaimer and limitation-of-liability language will be set by counsel.

7.Changes (link to this section)

We may update these terms; material changes will be communicated. Continued use after an update constitutes acceptance.
